These Terms of Use ("Terms") govern your use of the CalPets app and website. CalPets is licensed to you under Apple's Licensed Application End User License Agreement (the "Standard EULA"); these Terms supplement it. If they conflict, the Standard EULA prevails. By using CalPets you agree to these Terms and to our Privacy Policy.
1. The service
CalPets is a wellness and entertainment app that rewards everyday activity with progress for a virtual pet. Features, pets, seasons and rewards may change over time, and some features require an internet connection and access to Apple Health.
2. Health disclaimer
CalPets is not a medical device and does not provide medical advice. Activity numbers come from Apple Health and may be incomplete or inaccurate. Choose goals that are safe for you, listen to your body, and consult a doctor before starting a new exercise routine or if you have any health concerns.
3. Your account
You need to sign in with Apple to use CalPets and you must be at least 13 years old (or the minimum age in your country). If you are under the age of majority, use CalPets with the permission of a parent or guardian. You are responsible for activity on your account. You can delete your account at any time in the app.
4. Memberships and purchases
- CalPets offers optional auto-renewing subscriptions (monthly and yearly) and a one-time lifetime membership. Prices are shown in the app and on the App Store purchase sheet and may vary by region.
- Payment is charged to your Apple Account when you confirm the purchase. Subscriptions renew automatically unless turned off at least 24 hours before the end of the current period; your account is charged for renewal within 24 hours before the period ends.
- You can manage or cancel subscriptions in your Apple Account settings. Deleting the app or your CalPets account does not cancel a subscription.
- If a free trial is offered, any unused portion is forfeited when you purchase a subscription. Lifetime membership does not renew or expire.
- All purchases are processed by Apple, and refunds are handled by Apple under its policies.
5. Virtual items
Pets, skins, wallpapers, planets, badges, tickets and other in-app items are licensed to you for personal, non-commercial use within CalPets. They have no monetary value, cannot be exchanged for cash, and cannot be sold or transferred. Unclaimed seasonal rewards expire when the season ends.
6. Acceptable use
Please don't misuse CalPets. You agree not to reverse engineer, interfere with or overload the service, manipulate activity data or exploit bugs to obtain rewards, use offensive nicknames, or use CalPets in violation of any law. We may suspend or terminate accounts that violate these Terms.
7. Intellectual property
CalPets, its characters, artwork, animations and content are owned by us or our licensors and protected by intellectual property laws. Except for the limited license described here and in the Standard EULA, no rights are granted to you.
8. Disclaimers and limitation of liability
CalPets is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties and are not liable for indirect, incidental or consequential damages, or for loss of data or virtual items. Nothing in these Terms limits rights you have under consumer protection laws that cannot be waived.
9. Changes
We may update these Terms from time to time. We will post the updated version on this page and, for material changes, notify you in the app. Continuing to use CalPets after changes take effect means you accept the updated Terms.
